1. About us

This website is operated by Tam Shepherds Trick Shop, trading as Tam Shepherds (“we”, “us” and “our”).

We sell magic tricks, practical jokes, playing cards, books, costumes, accessories, merchandise and other products through this website.

2. Using our website

By using this website or placing an order with us, you agree to these Terms.

You must not misuse the website, interfere with its operation, introduce malicious software, attempt unauthorised access, or use the website for unlawful purposes.

We may restrict access to the website where reasonably necessary for security, maintenance, fraud prevention or misuse.

3. Products

We make reasonable efforts to describe and display our products accurately.

Colours, packaging and other minor details may occasionally differ from photographs, particularly where manufacturers update packaging or products are handmade, vintage-style or supplied in assorted designs.

All products are subject to availability. We may discontinue products or change products and prices before an order is accepted.

Nothing in these Terms affects your statutory rights. Goods supplied to consumers must, where applicable, be as described, of satisfactory quality and fit for purpose.

4. Prices

Prices displayed on the website are the prices payable at the time an order is placed, unless an obvious pricing error has occurred.

Prices include VAT where applicable.

Delivery charges are shown separately and are explained on our Shipping Costs page.

We may change prices at any time, but a price change will not affect an order that we have already accepted.

5. Placing an order

When you place an order, you are making an offer to buy the products in your basket.

The automatic order confirmation that you receive acknowledges that we have received your order. It does not necessarily mean that we have accepted it.

A contract between you and us is formed when we confirm that your order has been dispatched.

Before dispatch, we may cancel an order where reasonably necessary, for example if:

  • an item is unavailable;
  • there has been an obvious pricing or product-information error;
  • we cannot obtain authorisation for payment;
  • we reasonably suspect fraud or misuse; or
  • we cannot deliver to the address provided.

If we cancel an order after taking payment, we will refund the amount paid for the cancelled item or order.

6. Payment

Payment must be made using one of the payment methods offered at checkout.

You must provide accurate billing, delivery and contact information.

We may carry out or use third parties to carry out reasonable payment and fraud-prevention checks.

7. Delivery

Delivery charges, destinations and estimated delivery times are set out on our Shipping Costs page.

Delivery dates are estimates unless we expressly agree otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, but we will comply with our legal obligations concerning delayed or undelivered goods.

Responsibility for the goods passes to you when you, or a person identified by you, takes physical possession of them.

For international orders, you may be responsible for customs duties, import taxes or other charges imposed by the destination country.

8. Returns, cancellations and faulty goods

Your rights to cancel an online order, return unwanted goods and obtain remedies for faulty, damaged or incorrectly described goods are set out in our Returns & Refunds Policy.

For most eligible online purchases, consumers have a statutory right to notify us that they wish to cancel within 14 days of receiving the goods. Some products are legally exempt from this right.

Unless the goods are faulty or we have agreed otherwise, customers are responsible for the cost of returning change-of-mind purchases.

Nothing in these Terms or our Returns & Refunds Policy limits your statutory consumer rights.

9. Product availability and errors

We try to keep prices, stock levels, descriptions and other website information accurate, but occasional errors can occur.

If we discover an obvious error before accepting your order, we may contact you to correct it or cancel the affected item and refund any payment taken.

We will not use this provision to avoid an order merely because fulfilling it has become less commercially advantageous to us.

10. Our responsibility to you

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

If you are purchasing as a consumer, we do not exclude or limit liability where it would be unlawful to do so. In particular, nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • your statutory rights relating to goods, services or digital content.

We supply products through this website for private and domestic use. If you use products for commercial or business purposes, we are not responsible for business losses such as loss of profits, revenue, contracts or business opportunities, to the extent permitted by law.

11. Intellectual property

The Tam Shepherds name, branding, website content, photographs, graphics, text and other material belonging to us may not be reproduced, distributed or commercially exploited without permission, except where permitted by law.

Third-party trademarks, product images and other intellectual property remain the property of their respective owners.

12. Third-party services and links

Our website may contain links to, or use services provided by, third parties such as payment providers, delivery companies and social-media platforms.

We are not responsible for the content of independent third-party websites. Their own terms and privacy policies may apply when you use them.

13. Personal information

We process personal information in accordance with our Privacy Policy.

Payment information may also be processed by Shopify and the relevant payment provider in accordance with their own privacy policies.

14. Changes to these Terms

We may update these Terms from time to time, for example because our business, website or applicable law changes.

Changes apply to future use of the website and future orders. We will not retrospectively change the contractual terms applying to an order that has already been accepted.

The current version and its last-updated date will be published on this page.

15. Governing law

These Terms are governed by Scots law.

If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory rights provided by the law applicable where you live and may have the right to bring proceedings in the courts of that part of the United Kingdom.

Customers outside the UK may also have mandatory consumer rights under the laws applicable in their country which these Terms do not remove.
